This article considers Hugo Grotius’s ideas on a specific topic of commercial law, analysing his position and potential contributions to early modern Dutch insolvency legislation. It might be questioned how ‘Hollandic’ Grotius’s interpretations of legal solutions for insolvency as presented in the Inleidinge tot de Hollandsche Rechts-Geleerdheid actually were. Grotius’s treatment of cessie van goede is relatively strict, whereas compositions are hardly mentioned. A rather different image rises from his later work. Here, Grotius displays a more radical view, in specific (...) cases allowing the sovereign to interfere in private property rights and to restructure debts for the common good. It is an intriguing question if and to what extent these ideas can be related to contemporary Dutch insolvency practices. (shrink)

The destruction of the temple in Jerusalem by the Romans in AD 70 was an unquestionably traumatic event in the history of the Jewish people. By all accounts it was a social, political, and theological disaster. As such, contemporary Jewish figures wrestled with the meaning of the event. This article analyses the efforts by two figures in this internal Jewish dialogue to provide this meaning, namely, the historian Josephus and Jesus of Nazareth. We will see that in both cases the (...) meaning of the destruction was rooted in the firm conviction of the God of Israel’s existence and his self-revelation in Scripture. The temple was destroyed not apart from God or in spite of God, but in full accordance with his will. This will, moreover, was judged to be accessible through Scripture, both in terms of its prophetic value and its establishment of a metanarrative – redemptive history – that provided a framework for historical events. In addition, the reason for the destruction was judged by both to be the sins of (certain) people. The major difference between them lay rather in the question of which sins exactly were judged to be responsible. (shrink)

To address the burden of maternal morbidity and mortality in low‐ and middle‐income countries (LMICs), research with pregnant women in these settings is increasingly common. Pregnant women in LMIC‐context may experience vulnerability related to giving consent to participate in a clinical trial. To recognize possible layers of vulnerability this study aims to identify factors that influence the decision process towards clinical trial participation of pregnant women in an urban middle‐income setting. This qualitative research used participant observation, in‐depth interviews, and focus (...) group discussion with medical staff and pregnant women eligible for trial participation, at a regional hospital in Accra, Ghana. Besides lack of familiarity with modern scientific concepts, specific factors influencing the decision‐making process were identified. These include a wide power difference between health provider and patient, and a different perception of risk through externalization of responsibility of risk management within a religious context as well as a context shaped by authority. Also, therapeutic misconception was observed. The combination of these factors ensued women to rely on the opinion of the medical professional, rather than being guided by their own motivation to participation. Although being a (pregnant) woman per se should not render the label of being vulnerable, this study shows there are factors that influence the decision process of pregnant woman towards trial participation in a LMIC context that can result in vulnerability. The identification of context‐specific factors that can create vulnerability facilitates adaptation of the design and conduct of research in a culturally competent manner. (shrink)

The phrase 'beyond historicism' is usually associated with Bielefeld historians like Hans Ulrich Wehler and Jürgen Kocka, who attempted to turn the study of history into a social science, but a better candidate would be the sociologist Niklas Luhmann, who happened to teach as well in Bielefeld during the 1970's and 1980's. Luhmann had little affinity with the project of his colleagues from the history department. He took the opposite view that the social sciences suffered from a naive enlightenment view (...) and should become more history minded. Like the historicists of the early nineteenth century Luhmann was indirectly inspired by the philosophy of Leibniz. Although Luhmann's theory of social systems may seem miles away from the daily interests of most historians, it can be interpreted as an Aufhebung of historicism. This will be demonstrated for two important concepts, the autopoietic system which incorporates the historicist notion of individuality and the concept of second order observation which can be read as an abstract redescription of what historicists meant by the historical method. ABSTRACTThe metaphor of historical distance often appears in discussions about the study of contemporary history. It suggests that we cannot see the past in perspective if we are too near to it. According to founding fathers like Ranke and Humboldt, temporal distance is required to discern historical “ideas” or forms. The argument may have some plausibility, but the presupposition is plainly false, since we cannot see the past at all. This leaves us with the question of what to make of (...) the so‐called historical forms. This article discusses three different views. The first, historicist, view is objectivist and localizes historical forms in the past. The second, narrativist, view is subjectivist and localizes historical forms in the realm of imagination and representation. The third view goes beyond the other two in that it considers both sides. It does not use a one‐sided but a two‐sided concept of form, which hinges on the idea of a distinction. This means that historical forms occupy both sides of the subject–object distinction or the present–past distinction. Because the subject–object terminology is confusing, the essay employs an alternative distinction between first‐ and second‐order observation. With the help of this distinction, it is possible to redescribe the distance metaphor in such a way that the theoretical status of contemporary history becomes less enigmatic. (shrink)

The subject of this article is the way in which Grotius imitated his Roman model Tacitus in his own Annales. He does this by quotations and allusions, but also, more subtly, by adopting some of Tacitus stylistic peculiarities like brevitas, inconcinnitas and the insertion of sententiae. The imitation of Tacitus is most conspicuous in important sections of the Annales like the opening chapters and the introductions of the main characters. Tacitus is the prime model of Grotius, but not the only (...) one, as is shown by borrowings from Sallust, Pliny the Younger and Vergil. (shrink)

J.H. van den Berg was a member of the Utrecht school of phenomenology that flourished in Holland during the 1950s and early 1960s. He was a psychiatrist who had a private practice and he taught at the University of Leiden. Along with other members of the Utrecht school, not all of whom were psychiatrists, he was among the first to apply the insights drawn from existential-phenomenological philosophy to psychology and psychiatry. As with the philosophers, he emphasized that subjectivity was engaged (...) with the world and its activities had to be described. He emphasized that insights into experience as lived, or the phenomenal level, was what was critical for psychologists to understand. (shrink)

Theory Reduction in the Social Sciences. The example of balance theories. A central topic both in philosophy of science as well as in the empirical sciences is the reconstruction of the relations between theories. In the past comparisons of theories by means of traditional linguistic methods have proved to be extremely difficult and complicated. In this article the reconstruction of intertheoretical relations based on model-theoretical terms is propagated, as formulated within the structuralist view of theories. The efficiency of a model (...) theoretical based comparison of theories is demonstrated by two theory elements from the social science research program of balance theories: The basic element by Heider and the transitivity theory by Holland and Leinhardt. First of all both theory elements are introduced informally and reconstructed in the structuralist format. On the basis of these reconstructions can be shown, that the Heider theory can be formally reduced to the Holland-Leinhardt theory and that the theory younger in history means an improvement. However, an integration of all balance theoretical elements into a theory net is not possible. (shrink)

As psychoanalysis becomes more and more important to literary studies and the accompanying literature bulks larger and larger, students often feel overwhelmed, not knowing where to turn for readings that will open up the subject. In diesem Aufsatz untersuchen wir Leibniz' Ansicht uber die "Ars Analytica". Gelegenheit dazu bietet die Diskussion uber die Losung der sogenannten "Probleme eines Hollanders". Es geht dabei um 12 Probleme uber das Dreieck. Gegeben sind in diesen Problemen: einer der Basiswinkel, die Differenz von Basissegmenten und ein Verhaltnis,das bei den einzelnen Problemen variiert zwischen den Seiten des Dreiecks. "Die Probleme des Hollanders" sind aus mehreren Grunden wichtig. Sie liefern einen aufschllussreichen Test, den Stand der Mathematik in Italien in der zweiten (...) Halfte des 17. Jahrhunderts zu prufen. Sie lassen das Nebeneinanderbestehen unterschiedlicher mathematischer Methoden erkennen, und zwar klassischer und moderner Methoden. Schliessich sind die Probleme sehr interessant fur den Stand der Gedanken, die Leibniz zu ihrer Behandlung aussert. (shrink)

Should nurses have their own ethics to match specific problems met in their daily routines? How do nurses act in a society that is changing from a 'monocultural' to an 'intercultural' structure? What are the ethical consequences of these changes for their many tasks? How can the ethical aspects be taught to nurses? This article describes the current status of nursing ethics in the curriculum taught in schools of higher education for nurses in The Netherlands. Aspects of the debate on (...) nursing ethics are outlined and ideas about its future as a subject and discipline in nurse education are offered. Est-ce que le personnel infirmier doit avoir son éthique à soi pour faire face aux problèmes spécifiques dans la routine journalière? Et comment les infirmiers/ères se comportent-ils dans une société qui est en train de changer de la 'monoculture' en 'interculture'? Quels sont les conséquences éthiques de leur tâches? Comment peuvent ces aspets éthiques être enseignés aux infirmiers/ères? Cet article parle de l'état courant de l'éthique infirmier dans l'enseignement dans les écoles de l'education supérieure pour infirmiers/ères en Hollande. En plus, il donne une esquisse de la discussion sur l'éthique infirmier et donne quelques idées pour le futur de l'éthique infirmier comme sujet et discipline en soi dans l'éducation des infirmiers/ères. Sollte das Pflegepersonal seine eigene Ethik haben um den spezifischen Problemen seiner täglichen Routine gewachsen zu sein? Wie soll das Pflegepersonal in einer Gesellschaft handeln, die im Wechsel ist von einer 'Monokultur' zu einer 'Interkultur'? Was sind die ethischen Konsequenzen ihres handeln? Wie können diese ethischen Aspekte dem Pflegepersonal gelehrt werden? Dieser Artikel beschreibt den gegenwärtigen Zustand der Krankenpflege-Ethik im Lehrplan der Schulen für Höhere Ausbildung für Pflegepersonal in Holland. Information is clearly vital to public health, but the acquisition and use of public health data elicit serious privacy concerns. One strategy for navigating this dilemma is to build 'trust' in institutions responsible for health information, thereby reducing privacy concerns and increasing willingness to contribute personal data. This strategy, as currently presented in public health literature, has serious shortcomings. But it can be augmented by appealing to the philosophical analysis of the concept of trust. Philosophers distinguish trust and trustworthiness from (...) cognate attitudes, such as confident reliance. Central to this is value congruence: trust is grounded in the perception of shared values. So, the way to build trust in institutions responsible for health data is for those institutions to develop and display values shared by the public. We defend this approach from objections, such as that trust is an interpersonal attitude inappropriate to the way people relate to organisations. The paper then moves on to the practical application of our strategy. Trust and trustworthiness can reduce privacy concerns and increase willingness to share health data, notably, in the context of internal and external threats to data privacy. We end by appealing for the sort of empirical work our proposal requires. (shrink)

This is the first detailed study in any language of the single most influential theory of the modern state: Samuel von Pufendorf's account of the state as a 'moral person'. Ben Holland reconstructs the theological and political contexts in and for which Pufendorf conceived of the state as being a person. Pufendorf took up an early Christian conception of personality and a medieval conception of freedom in order to fashion a theory of the state appropriate to continental Europe, and which (...) could head off some of the absolutist implications of a rival theory of state personality, that of Hobbes. The book traces the fate of the concept in the hands of others - international lawyers, moral philosophers and revolutionaries - until the early twentieth century. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 62.2 (2001) 313-333 [Access article in PDF] Vestige of the Third Force: Willem Bilderdijk, Poet, Anti-Skeptic, Millenarian Joris van Eijnatten One of the unfortunate consequences of Babel is that only the Dutch read Dutch poetry. 1 Although English-speaking historians may have heard of the seventeenth-century poet Joost van den Vondel, who generally qualifies as the greatest literary artist of the Netherlands, virtually no (...) one outside Holland knows Willem Bilderdijk (1756-1831), poet, jurist, and man of learning. Robert Southey, having met the poet at his home in Leiden in 1825, lamented several years later the fact that Bilderdijk's fame had not traversed national boundaries: "And who is Bilderdyk?" methinks thou sayest: A ready question; yet which, trust me, Allan, Would not be asked, had not the curse that came From Babel, clipt the wings of Poetry. 2When Southey sojourned in the Netherlands, Bilderdijk had already established his reputation as one of the few unconventional figures in Dutch history, comparable, in this sense, to Coornhert and Spinoza. The most outstanding poet of his age, he dominated nineteenth-century Dutch literature through his versatility, rhetorical prowess and sheer output. He is reputed to have written 300,000 lines of verse, not counting his unpublished poems. He practiced virtually all literary genres, from Pindaric odes and erotic rhyme to didactic poetry. Versed in the classics, he wrote numerous translations of, among many others, Homer, Sophocles, Anacreon, Callimachus, Horace, and Ovid. Bilderdijk was a prolific [End Page 313] writer of essays on subjects ranging from moral philosophy, epistemology, and natural law to aesthetics, architecture, and botany. He translated theological and devotional works, including Thomas Chalmers's Evidence and Authority of the Christian Revelation, Chrysostome's sermons, and books on freemasonry and pneumatology. Besides contributing to perspective drawing, he wrote the first geological study in Dutch. His History of the Fatherland appeared posthumously in thirteen volumes. He himself regarded his linguistic studies and literary essays as his main achievement. Bilderdijk filled thousands of pages with his idiosyncratic views on the gender of nouns, the alphabet, grammar, spelling, medieval manuscripts, tragedy, and drama in general.Not surprisingly, Bilderdijk's varied interests and comprehensive mind have led to different interpretations of his thought. Most are one of two kinds. Writers subscribing to the first interpretation regard him as a somewhat strange but devout apologist for Calvinist orthodoxy. They stress the fact that Bilderdijk was the only intellectual who, in the midst of the soul-destroying rationalism propounded by a complacent liberal establishment, dared to cry out against Revolution and Enlightenment, thus revivifying the religious heart of the nation. 3 Those who follow the second interpretation emphasize the Romantic nature of his thought. This group tends to look upon Bilderdijk as the only true Dutch Romantic, a Wordsworth and Coleridge combined, a metaphysical if rather erratic genius who outgrew the intellectual marshlands of his native country. Writers in this tradition stress his definition of poetry as a spontaneous overflow of feeling, his linguistic achievements, his preoccupation with geology, and his visionary view of Dutch history. 4 One major interpreter, commenting on Bilderdijk's "real position as a philosopher," has stated that "to me there can be no doubt that Bilderdijk should be placed among the post-Kantian idealists like Fichte and Schelling (cf., again, Coleridge!)." 5Such statements are largely products of wishful thinking. Bilderdijk was not a devout Calvinist. He hardly ever went to church, his theology exhibits suspiciously heterodox leanings, and his professed adherence to the doctrine of predestination had less to do with a profound knowledge of the articles of Dort than mystical resignation. Similarly, the depiction of Bilderdijk as a post-Kantian idealist is sympathetic but lacks any evidence. _Nomad Citizenship_ argues for transforming our institutions and practices of citizenship and markets in order to release society from dependence on the state and capital. It changes Deleuze and Guattari’s concept of nomadology into a utopian project with immediate practical implications, developing ideas of a nonlinear Marxism and of the slow-motion general strike. Responding to the challenge of creating philosophical concepts with concrete applications, Eugene W. Holland looks outside the state to analyze contemporary political and economic development using the ideas (...) of nomad citizenship and free-market communism. Holland’s nomadology seeks to displace capital-controlled free markets with truly free markets. Its goal is to rescue market exchange, not perpetuate capitalism—to enable noncapitalist markets to coordinate socialized production on a global scale and, with an eye to the common good, to liberate them from capitalist control. In suggesting the slow-motion general strike, Holland aims to transform citizenship: to renew, enrich, and invigorate it by supplanting the monopoly of state citizenship with plural nomad citizenships. In the process, he offers critiques of both the Clinton and Bush regimes in the broader context of critiques of the social contract, the labor contract, and the form of the state itself. (shrink)

We establish an equiconsistency between (1) weak indestructibility for all $\kappa +2$ -degrees of strength for cardinals $\kappa $ in the presence of a proper class of strong cardinals, and (2) a proper class of cardinals that are strong reflecting strongs. We in fact get weak indestructibility for degrees of strength far beyond $\kappa +2$, well beyond the next inaccessible limit of measurables (of the ground model). One direction is proven using forcing and the other using core model techniques from (...) inner model theory. Additionally, connections between weak indestructibility and the reflection properties associated with Woodin cardinals are discussed. This work is a part of my upcoming thesis [7]. (shrink)

How far should we go in protecting and promoting public health? Can we force people to give up unhealthy habits and make healthier choices, or does everyone have the right to decide their own lifestyle? Should we stop treating smokers who refuse to give up smoking? Should we put a tax on fatty foods and ban vending machines in schools to address the obesity epidemic? Should parents be required to have their children vaccinated? Are some of our screening programmes unethical (...) Downs syndrome screening, for example or should we be screening people for more conditions, such as Huntington disease? Such questions are at the heart of public health ethics. Holland shows that to understand and debate these issues requires philosophy: moral philosophies, such as utilitarianism and deontology, as well as political philosophies such as liberalism and communitarianism. And philosophy informs other aspects of public health, such as epidemiology and health promotion. The aim of this book is to provide a lively, accessible and philosophically informed introduction to such issues. It is an ideal textbook for students taking courses in public health ethics. And since this book develops systematic discussions of issues in public health ethics, there is also much here to engage and challenge the more advanced reader. (shrink)

We observe that Schrödinger’s equation may be written as two real coupled Hamilton–Jacobi (HJ)-like equations, each involving a quantum potential. Developing our established programme of representing the quantum state through exact free-standing deterministic trajectory models, it is shown how quantum evolution may be treated as the autonomous propagation of two coupled congruences. The wavefunction at a point is derived from two action functions, each generated by a single trajectory. The model shows that conservation as expressed through a continuity equation is (...) not a necessary component of a trajectory theory of state. Probability is determined by the difference in the action functions, not by the congruence densities. A corollary establishes relations between displacement functions in diverse trajectory models, including where the functions obey different symmetry transformations. Kant described the state as a ‘moral person’, and did so when dealing with international relations. For all the interest in his contribution to the theory of global politics, the locution according to which Kant characterized the state has received very little attention. When notice has been taken of it, the moral personality of the state has moved arguments in opposing directions. On one recent reading, when Kant called the state a moral person he intended to indicate that it possessed (...) certain duties to itself and to others, for the sake of which it could be coerced to leave the international state of nature. On another, the juridical compulsion of states to join a state of nations or world republic is categorically ruled out because this would impair their moral personality. Both cannot be right. In this article, I analyse Kant’s notion of moral personhood, contextualizing it within his wider philosophical concerns. On the basis of this groundwork I put forward an argument about Kant’s theory of the moral person of the state which allows me to show how he in fact was able coherently to incorporate two seemingly contradictory arguments about the state as an international actor in a single argument, and present this as my solution to what I call the Perpetual Peace Puzzle. Leadership and folIowership are unified in an interdependent relationship exemplified by the idea of teamwork. Ethical concems are among the valuational elements essential to developing loyalty and trust in this relationship. However, because of their need to maintain power and distance, self-serving leaders may become detached from how their actions are perceived and reacted to by followers. This pattern can be especially damaging to teamwork when leaders continue to receive disprortionate rewards despite their poor performance, especially when coupled with organizational (...) downsizing and layoffs. Implications are drawn regarding the ethics of equity, responsibility, and accountability in the exercise of authority and power. (shrink)

This paper discusses the viability of a virtue-based approach to bioethics. Virtue ethics is clearly appropriate to addressing issues of professional character and conduct. But another major remit of bioethics is to evaluate the ethics of biomedical procedures in order to recommend regulatory policy. How appropriate is the virtue ethics approach to fulfilling this remit? The first part of this paper characterizes the methodology problem in bioethics in terms of diversity, and shows that virtue ethics does not simply restate this (...) problem in its own terms. However, fatal objections to the way the virtue ethics approach is typically taken in bioethics literature are presented in the second section of the paper. In the third part, a virtue-based approach to bioethics that avoids the shortcomings of the typical one is introduced and shown to be prima facie plausible. The upshot is an inviting new direction for research into bioethics' methodology. (shrink)

The recent genome sequencing of a non‐vertebrate deuterostome, the ascidian tunicate Ciona intestinalis, makes a substantial contribution to the fields of evolutionary and developmental biology.1 Tunicates have some of the smallest bilaterian genomes, embryos with relatively few cells, fixed lineages and early determination of cell fates. Initial analyses of the C. intestinalis genome indicate that it has been evolving rapidly. Comparisons with other bilaterians show that C. intestinalis has lost a number of genes, and that many genes linked together in (...) most other bilaterians have become uncoupled. In addition, a number of independent, lineage‐specific gene duplications have been detected. These new results, although interesting in themselves, will take on a deeper significance once the genomes of additional invertebrate deuterostomes (e.g. echinoderms, hemichordates and amphioxus) have been sequenced. With such a broadened database, comparative genomics can begin to ask pointed questions about the relationship between the evolution of genomes and the evolution of body plans.
